QRS Warranty Policy 
Hardware Warranty
All instruments sold and supplied by QRS Diagnostic are guaranteed to be free from defects in material and workmanship for a period of 3 years from date of purchase.  ECG Lead Wires are guaranteed for 1-year. All other supplies and accessories carry a 90-day limited warranty.  Supplies and accessories include: oximetry fingertip sensors, all cables (serial cables, connections to PCs, etc.).   If in the judgment of QRS Diagnostic the instrument is proven to be defective during the warranty period it will be repaired or replaced with no charge for parts or labor.  An extended hardware warranty is available at additional cost for stand-alone devices.
This warranty does not cover any instrument which has been damaged by accident, misuse, abuse or has been altered or repaired by anyone other than an authorized QRS Diagnostic service center.  This warranty also does not cover any instrument that has had a serial number removed, defaced or rendered illegible.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS AND IS HEREBY LIMITED TO REPAIR OR REPLACEMENT FOR INSTRUMENTS FOUND DEFECTIVE DURING THE WARRANTY PERIOD.  AN AUTHORIZED QRS DIAGNOSTIC, LLC AGENT, MUST MAKE ALL REPAIRS.  INSTRUMENTS SENT BY MAIL OR COMMON CARRIER SHOULD BE INSURED AGAINST LOSS OR DAMAGES, AS THEY ARE NOT COVERED BY THIS WARRANTY.
Customer is responsible for backing up their data prior to returning the instrument to QRS Diagnostic. QRS Diagnostic assumes no liability for lost data during repair or upgrade.
Software Warranty and Licensing Agreement
The software is protected by copyright law and international treaties.  Unauthorized reproduction, distribution or reverse engineering of the software, or any portion of it, may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law.
License
  • You may use the software on a single computer or in a single network with the purchase of the Integrated Data Management Software (IDMS).
  • You may make a back up copy of the software in support of your use of the software.
  • You may transfer the software and license to another party if the party agrees to accept the terms and conditions of this agreement.  If you transfer the software you must turn over all copies of the software to the same party or destroy any copies not transferred.
Limited Warranty and Remedies
In no event shall QRS Diagnostic or the software distributor be liable for any damages resulting from loss of data, loss of revenue or for any incidental or consequential damages incurred arising out of or relating to the use of the software.  Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.  This warranty gives you specific legal rights. You may have other rights that vary from region to region.
Limited Warranty
The “Warranty Period” means 1-year from the date of installation.  QRS Diagnostic warrants that, at the time of delivery to Customer and during the Warranty Period identified above: (i) the Software shall perform reasonably in accordance with the specifications set forth in QRS Diagnostic's then current commercially available Documentation for the Software or Hardware; (ii) the media on which the Software is delivered shall be free from defects in material and workmanship; (iii) QRS Diagnostic warrants that, to the best of its knowledge, the QRS Diagnostic Software does not contain any viruses or other malicious computer instructions, devices or techniques that can or were designed to threaten, infect, damage, disable or shut down the software or any other computer system; (iv) Software available without charge for use, modification and distribution is often licensed under terms that require the user to make the user’s modifications to the Open Source software or any software that the user “combines” with the Open Source software freely available in source code form. QRS Diagnostic warrants that the QRS Diagnostic Software contains no such Open Source software; (v) and QRS Diagnostic warrants that the QRS Diagnostic Software does not contain, nor will contain in the future, any third party software or components that require payment to third parties by the user.
QRS Diagnostic reserves the right to revise its publications and program(s) without obligation to notify customer of such a revision.
Customer Remedy
If the Software fails to comply with the limited warranty as set forth herein during the Warranty Period, QRS Diagnostic will use commercial efforts to repair or replace any such Software; or, at QRS Diagnostic’s option, accept the return of the Software and refund the License fees, or an equitable portion thereof, paid by Customer for the Software.
Support
QRS Diagnostic or its distributor provides free technical support of the software during the warranty period.  Customers will receive all commercially available maintenance releases, minor enhancements to the user interface, toll-free telephone consultations, and assistance on the software during normal business hours during the warranty period.
Extended support is available at an additional cost.
Infringement Indemnity
QRS Diagnostic will indemnify, defend and hold Customer harmless against any and all claims that the Products, or the operation of the Products, infringe(s) the intellectual property rights of a third party.
